Rights & Obligations of Investors
At OptiGains Private Wealth, we are committed to maintaining the highest standards of transparency, fairness, and professionalism in our dealings with investors. The following sets out the key rights and responsibilities of investors, along with the obligations of the Mutual Fund Distributor.
Rights of Investors
Investors are entitled to the following rights:
- Right to Complete and Accurate Information:Investors have the right to receive complete, accurate, and relevant information regarding a Mutual Fund scheme, including its investment objective, risk factors, costs, expenses, and other material features, before making an investment decision.
- Right to Transparency in Costs and Compensation: Investors have the right to be informed of applicable costs, fees, commissions, and other charges associated with their investments, including trail commissions received by the distributor from AMCs, wherever applicable.
- Right to Risk Profiling: Investors have the right to undergo an appropriate risk-profile assessment before any investment recommendation is made, in accordance with applicable regulatory requirements.
- Right to Suitability Disclosure: Where a proposed investment is considered unsuitable or falls outside the investor’s assessed risk profile or risk tolerance, the investor has the right to receive appropriate written communication regarding such assessment, wherever applicable.
- Right to Grievance Redressal: Investors have the right to access a transparent, fair, and timely grievance-redressal mechanism for addressing complaints or concerns relating to their investments and services.
- Right to Data Privacy: Investors have the right to access and correct their personal information and, where applicable, request deletion of such information, subject to applicable data protection laws and regulatory requirements.
- Right to Invest in Direct Plans: Investors may choose to invest directly in Direct Plan schemes through the respective AMCs. Direct Plans generally have a lower expense ratio than Regular Plans.
- Right to Switch Plans: Investors may switch between Regular and Direct Plans, subject to the applicable scheme provisions, AMC procedures, taxation, and regulatory requirements.
- Right to Escalate Grievances: Where a grievance remains unresolved, investors may escalate the matter through applicable regulatory and dispute-resolution mechanisms, including SEBI SCORES and SMART ODR, as applicable.
- Right to Account Statements: Investors have the right to receive periodic portfolio statements, transaction statements, and Consolidated Account Statements (CAS), as applicable under prevailing regulatory requirements.
Obligations of Investors
Investors are expected to:
- Provide complete, accurate, and up-to-date KYC and personal information and promptly notify the relevant intermediary or AMC of any changes.
- Complete the required risk-profiling process before investing and review or update their risk profile periodically, particularly following significant changes in financial circumstances, investment objectives, or risk tolerance.
- Carefully read and understand the applicable Scheme Information Document (SID), Statement of Additional Information (SAI), Key Information Memorandum (KIM), and other relevant product or scheme documents before investing.
- Keep personal, bank account, contact, nominee, and other registered information updated and promptly report any changes.
- Regularly review portfolio statements, transaction confirmations, and the Consolidated Account Statement (CAS), and promptly report any discrepancies or unauthorized transactions.
- Protect confidential information: Investors must not share login credentials, passwords, PINs, OTPs, or other authentication details with anyone, including persons claiming to represent OptiGains Private Wealth or any AMC.
- Complete all applicable FATCA/CRS self-certification requirements and provide accurate information and documentation as required under applicable laws.
- Promptly report any suspected fraud, phishing attempt, unauthorized communication, or impersonation involving OptiGains Private Wealth, its representatives, AMCs, or other financial institutions.
Obligations of the Distributor
OptiGains Private Wealth, in its capacity as a Mutual Fund Distributor, is committed to:
- Acting in the best interests of investors and adhering to the applicable AMFI Code of Conduct and regulatory requirements.
- Conducting appropriate risk profiling before making investment recommendations and taking reasonable steps to ensure that recommendations are appropriate and suitable based on the investor’s stated objectives, risk profile, and investment requirements, wherever applicable.
- Providing transparent disclosure of applicable commission and distribution-related compensation in accordance with regulatory requirements and the policies of the respective product providers.
- Refraining from making any false, misleading, or unsubstantiated representations and not guaranteeing or assuring any specific return or investment performance.
- Ensuring that transactions are appropriately tagged with the applicable ARN/EUIN and other mandatory identifiers, wherever required.
- Providing appropriate assistance for investor grievances and maintaining relevant complaint records in accordance with applicable regulatory requirements.
- Maintaining investor, transaction, and other relevant records in accordance with applicable statutory and regulatory requirements.
- Complying with applicable SEBI regulations, AMFI guidelines, circulars, codes of conduct, and the applicable AMFI Master Circular for Mutual Fund Distributors, as amended or updated from time to time.
